也就是说，拾得的财物其所有权人仍为失主，而不是拾到财物的人，所有权不因为财物遗失而发生转移，因而拾到财物必须归还失主。至于酬金，双方可以友好协商，如果失主不愿意支付酬金，拾得人不得强要酬金。
